Fake laws, fake judges, but … real punishments

Many federal and State agencies have a shadow system of courts – we cannot call them a justice system, for they are most injust. In some States, this power is delegated down to counties and other local governments.

In our opinion, they are nothing more or less than a method of tyranny. Over the years, many of us have had to deal with these so-called “administrative law judges” and their bogus courts.

These judges do not adjudicate real laws: statutes and such legislation passed by legislatures and approved (and supposedly enforced) by the executive. Instead, they deal mostly with “administrative ‘law.” That is a euphemism for government regulations. Sometimes they deal with “codes” – a term used to describe documents of hundreds or thousands of pages filled with prohibitions and mandates. Codes usually incorporated into statutes by reference.

An example is the very common International Property Management Code (IPMC), last updated in 2024. It is one of dozens of international codes (see a list here) frequently adopted by various local governing councils – cities, towns, counties, etc. You can rest assured that few (if any) of the members of those councils or boards have actually read anything much in the codes that they pass and then have their staff bureaucrats and thugs enforce against the people and businesses of the community under their jurisdiction (rule). Sometimes the various codes have blanks to fill in. (An example: how tall are you allowed to have your grass? 6 inches, 10 inches, 12 inches?)

Other parts of the codes dictate how long you have to shovel the snow off the sidewalks in front of your property. (Which, by the way, are seldom your property: they are in a “right of way” which is owned by a government.) And how often you must remove the litter from those rights-of-way (almost always dumped by people driving or walking by your property). At your expense, of course, not that of the government. And how tall your fence can be without getting a permit/license. What color you can paint your house, use for your roof, or paint your trim. Whether you can plant a garden – especially in your front yard.

These requirements are enforced by a system of fines: X dollars for a first violation, XX dollars for a second, XXX for a third, and so forth. With provisions to file liens against your property if you don’t pay. And deny you government permission if you don’t pay the fines. (An example: you have an outstanding fine because they said your grass is too tall. A windstorm blows off part of your roof: they won’t give you the building permit to repair that roof if you don’t pay the grass fine.)

All of these codes have a procedure to let you appeal those penalties. Usually you must first appeal to the boss of the inspector – the thug – who wrote you the ticket and levied the fine. Sometimes you have to then appeal to the boss’ boss. Or to the Board of County Commissioners or the Town Council. And then – maybe – you can appeal to a judge. But all too often this is an administrative law judge: not part of the supposedly-independent judicial branch of government. No, oh no. An administrative judge is employed by the same agency or entity that you are fighting against: their paycheck is from that government, the people that hire them and can fire them are the same people running that agency. And because they are “administrative” they can skirt part of the law. Juries? Don’t make us smile. Never mind that the fines are often thousands of dollars, and in some cases can result in forfeiture of property worth tens or hundreds of thousands. All based not on whether you actually violated a law established in a democratic and republican manner – but rather on regulations and guidelines and other documents you may have never seen or heard about. Or be allowed to see.

Just who do you think the “judge” is likely to decide is right: you? Or the government that they are a part of?

Of course, legally you can appeal that ruling to a real judge. But by then, you’ve already spent a whole lot of money and time fighting and losing. The appeals don’t happen very often.

And even then, who pays the salaries and the expenses of that real judge? Oh, my, just another government agency. And of course, the government agency’s representatives are supported by still more government agency employees: prosecutors and cops and a lot of others. Many people can’t afford to get that far up the chain of command of the tyrants.

Sometimes it is even worse. Even for employees of those government agencies. For example, in some States, a county employee who is fired by the board of county commissioners does have a right to appeal that firing. But guess who hears that appeal and decides on it first? Why, the same board of county commissioners that fired them – acting not just as the executive branch of county government but also as the judicial branch (and they are, of course, also the legislative branch – which is why they adopted those unread codes in the first place).

Folks, the deck is stacked. Not just stacked, but the cards are marked and the government types have two more full decks hiding up their sleeves. Along with a derringer.

Recently, the US Supreme Court has addressed the issue of rather or not “administrative law judges” and “courts” are constitutional. Or valid. Maybe – just maybe, they will decide that they are the tools of tyranny that they have been and are.

But don’t hold your breath.
